Chapter 1 General Provisions

Article 1 [Purpose]

These terms and conditions are intended to comply with the Telecommunications Business Act and its enforcement decree and to stipulate matters related to the conditions and procedures for using all services provided by RONFIC Co., Ltd. (hereinafter referred to as the "Company") and other necessary matters.

Article 2 [Effectiveness, Application, and Amendment of Terms and Conditions]

① These terms and conditions come into effect by being announced to the user. Users who agree to these terms and conditions and join as members will be subject to the agreed terms and conditions from the time of agreement, and if there are any changes to the terms and conditions, they will be subject to the amended terms and conditions from the time the changes take effect.

② The Company may change these terms and conditions when there are changes in circumstances or when there are significant business reasons, and the amended terms and conditions will take effect in the same manner as in the preceding paragraph.

Article 3 [User Consent for Personal Information Protection]

① The user's consent for personal information protection is as follows. Please check the Privacy Policy for details.

a. Purpose of collecting and using personal information

1. Personal identification, verification of real name, confirmation of intention to join, age-restricted service usage according to service usage

2. Notification of important information, securing communication channels for complaints

3. Materials for providing the latest information and personalized services

4. Prevention of wrongful use by bad members and unauthorized use

5. Provision of smooth and high-quality services

b. Personal information items collected

Name, date of birth, gender, height, mobile phone number, ID, password, history of strength exercise, result of strength test, email address, location information

c. Period of possession and use of personal information

The company will dispose of personal information without delay when the purpose of collection and use of personal information is achieved.

② The company shall not be responsible for any information, including personal information, exposed due to the user's fault.

③ The company can use location information only for the purpose of helping Bluetooth communication pairing between the company's product and the user's mobile device. However, it may automatically record and preserve location information usage and provision and verification materials for handling complaints with other business operators or users.

Article 4 [Principle of Priority of Related Laws and Regulations]

If any matter not specified in these Terms and Conditions is stipulated by related laws and regulations, such laws and regulations shall apply. Matters not stipulated in related laws and regulations shall be subject to the individual service usage agreement or operation policy established by the Company.

Chapter 2 Conclusion of Service Contract

Article 5 [Application for Service Use and Establishment of Service Contract]

① The service contract is established by the User agreeing to the contents of these Terms and Conditions, applying for use, and the Company approving the applied content.

② Customers who wish to use the Company's services must provide personal information requested by the Company.

③ In the case that the Company approves the User's application for use, the Company shall notify the User of their User ID and other content recognized as necessary by the Company.

④ The Company shall not approve the following applications for service contracts:

a. When applying using someone else's name

b. When applying without using their real name

c. When falsely entering information in the application for service contract

d. When applying with the purpose of harming social order or morals

e. When there is a risk that the User may engage in inappropriate behavior as a User

Chapter 3 Use of the Service

Article 6 [Use and Restriction of Services]

① The company will commence providing the service upon accepting the user's membership registration.

② The service is available 24 hours a day, 365 days a year, unless there are special circumstances in the company's business or technology.

③ The service hours specified in the previous paragraph may be restricted after prior notice to the user due to system regular checkups or other special reasons of the company. However, in case of unavoidable circumstances such as server equipment failure, emergency security issues, or critical bugs, the company may notify the user after the fact.

Article 7 [Management of User's Posted Content]

① The user is solely responsible for any losses or problems arising from the content posted or registered by the user, and the company is not responsible for such matters.

② The company may delete the content posted or registered by the user on the service without prior notice if it is determined to fall under any of the following:

a. Content that defames others or damages the honor of individuals or organizations

b. Content that violates public order and morals

c. Content that is deemed to be a criminal act

d. Content that infringes on the copyright or other rights of others

e. Other content that violates related laws or regulations established by the company

③ The copyright and other intellectual property rights of the works created by the company belong to the company.

④ The copyright of the content posted by the user on the service belongs to the user.

⑤ The user may not use the information obtained through the service for commercial purposes or allow third parties to use it without the company's approval.

⑥ The content posted by the user on the service may be displayed in search results, service-related promotions, etc., and may be partially modified, duplicated, or edited within the necessary scope for such display. In this case, the company must comply with the copyright law, and the user may request the deletion, exclusion from search results, or confidentiality of the content at any time. This applies while the company operates the service, and even after the user withdraws from the service.

Chapter 4 Obligations of the Contracting Parties

Article 8 [Obligations of the Company]

① The company shall enable users to use the service on the date of commencement of the service applied for by the user, unless there are special circumstances.

② The company shall have an obligation to continuously and stably provide services in accordance with the provisions of these Terms and Conditions.

③ The company shall process opinions raised by users through the prescribed procedures, and if it takes a certain period of time to process, it shall inform the user of the reasons and processing schedule.

④ The company shall strictly maintain the security of user information, use it only for operating or improving quality services, and shall not transfer it to other institutions or individuals for any other purpose.

Article 9 [Obligations of Users]

① The user is responsible for all management related to ID and password. The user shall be solely responsible for any damages or results caused by the exposure of ID and password due to the user's fault.

② If the user's ID is used illegally, the user must notify the company of that fact.

③ The user shall comply with the provisions of these Terms and Conditions and related laws and regulations.

④ The user shall diligently manage their personal information for the use of this service, and if there are any changes in the entered personal information, the user shall change it. Any damages caused by delay or omission of the user's personal information change are the responsibility of the user.

Chapter 5 Termination of the Contract and Restrictions on Use

Article 10 [Termination of the Contract and Restrictions on Use]

① The user may terminate the service contract at any time through the customer center or the member withdrawal menu.

② If the user requests termination, the company shall process it immediately in accordance with relevant laws and regulations.

③ If the login with the existing ID and password is not possible, it is considered to have been terminated, and we inform you that even existing users cannot use an ID that has been terminated once.

④ The company may terminate the service contract without prior notice or suspend the use of the service for a certain period of time if the user has engaged in the following actions:

a. Acts contrary to public order and morals

b. Acts related to criminal activities

c. Acts planned or executed for the purpose of undermining national interests or social public interests

d. Use of another person's ID and password

e. Actions that damage the reputation or cause disadvantages to others

f. Cases where the same user registers twice with different IDs

Article 11 [Restriction of Use and Procedures for Lifting Restrictions on Use]

① When the Company intends to restrict the use of the Service, it shall notify the User or their representative in writing or by telephone, etc., specifying the reason, date, and period of the restriction.

② However, in the event that the Company deems it necessary to urgently suspend the use, it may suspend the Service without going through the process of the preceding paragraph.

③ If the User or their representative who received the notice of suspension of use has any objections to the suspension, they may apply for a review of the decision.

④ The Company shall lift the suspension measures only when it confirms that the reason for the suspension has been resolved during the suspension period.

Chapter 6 Compensation, etc.

Article 12 [Compensation for Damages]

① In the event that the User violates the provisions of these Terms and Conditions, resulting in damages to the Company, the User who violated these Terms and Conditions shall compensate the Company for all damages incurred by the Company.

② If the Company receives a claim for compensation or any objection, including litigation, from a third party other than the User, due to illegal acts or violations of these Terms and Conditions committed by the User during the use of the Service, the User shall indemnify the Company at their own responsibility and expense. If the Company is not exempt from liability, the User shall compensate the Company for all damages incurred by the Company as a result of the indemnification.

Article 13 [Exemption from Liability]

① The Company shall be exempt from liability for the inability to provide the Service due to force majeure or other equivalent circumstances, the suspension or failure to provide telecommunications services by telecommunications business operators, or the interruption or failure of the Service due to unavoidable reasons such as the repair, replacement, regular inspection, or construction of the Service equipment, which have been announced in advance.

② The Company shall not be liable for the suspension of the Service, the failure to use the Service, or the termination of the contract due to the User's fault.

③ The Company shall not be liable for any damages caused by the User's failure to obtain the expected profits from using the Service, and shall be exempt from liability for any damages incurred by the User's choice or use of the Service.

④ The Company shall be exempt from liability for any problems caused by the User's computer environment or problems caused by network environment for which the Company is not responsible.

⑤ The Company shall not be obliged to intervene in disputes arising between Users or between Users and third parties through the Service, and shall not be liable for any damages caused thereby.

Article 14 (Governing Law and Jurisdiction)

① Any lawsuit between the Company and the user shall be governed by the laws of the Republic of Korea.

② In the event of any disagreement or dispute between the Company and the user regarding the use of the service, both parties must resolve it amicably by mutual agreement.

③ If the dispute under paragraph (2) cannot be resolved amicably and a lawsuit is filed, the lawsuit shall be subject to the jurisdiction of the Busan District Court.

Supplementary Provision

Article 1 [Effective Date]

These Terms and Conditions shall enter into force on December 1, 2020.
